Notice to Participants of Risk and Release and Waiver of Responsibility

Notice: EverGreen Land Co. owns several tracts of land in the North Leadville area, called “NorthRidge Backcountry.”
We welcome current and prospective residents of Lake County and their guests, as well as guests at approved Lake
County hotels, to access and use the land for outdoor nature recreation. Anyone who qualifies by their Lake County
affiliation is required to read this liability release and sign in the space below to be considered a licensee, which allows
access and use of the property. Anyone who accesses the property without signing the liability release is a
trespasser and subject to trespass laws and regulations.

Licensees/users are asked to stay at least 100 yards away from any residences and to not approach or enter land
outside the NorthRidge boundaries. EverGreen’s property boundaries are shown on the Lake County Assessor’s map.
No motorized vehicles and no loud noises are allowed on NorthRidge Backcountry.

This liability release and waiver applies for 2024. The experience of 2024 will determine whether EverGreen continues
this program into future years.

Release and Waiver: I exercise my own free and voluntary choice to participate in outdoor nature recreation at
NorthRidge Backcountry. I understand and assume all associated risks, including, but not limited to: sprains,
strains, contusions, lacerations, fractures, broken bones, paralysis, concussions, debilitating injuries, high altitude
and weather related exposures and illness, heat exhaustion, insect bites, hypothermia, mental anguish, emotional
trauma.

I agree to assume all risk of personal injury or loss, bodily injury (including death), damage to or loss of, or
destruction of any personal property. I release, waive, indemnify, hold harmless, and discharge EverGreen Land
Co., LP from all claims, damages, and injuries arising hereon. I, my personal and legal representatives, heirs,
successors and next of kin will not sue or make any claim against EverGreen, or any of its employees, agents,
owners, attorneys, insurers and representatives.

I hereby certify that I have read and understand the provisions above. For participants under 18 years of age, the
parent or guardian accepts the above terms and grants permissions on behalf of said minor, as permitted by C.R.S.
§ 13-22-107.
